It is sedition.
A Trump rally in Washington DC turned into a sedition’s insurrection when Rudy Giuliani said on stage: “let’s have a trial by combat” and Donald Trump said; “If you don’t fight for your country, you won’t have a country anymore.”
These statements of rebellion against the US government were spoken as congress tried to solidify the votes that, when counted, favor a replacement of Trump as POTUS and favor a new president, Joe Biden. An event that inflamed Trump so much that he eventually called the rally to Washington DC himself. The main idea: “Stop the Steal.”
To Trump’s mind, the election was stolen from him by fraudulent voting practices. There has been no evidence found of such fraudulent or even negligent activity.
Since Trump refused to accept the will of the American People through the sanctity of their vote, and carried conspiracy theories of voter fraud to the extremity of convincing at least thousands of people at a pro-Trump rally to take up arms and take back the country that is being “stolen” from them, the rally marched on Capitol Hill, lost 4 of their own, killed a Capitol Police officer, terrified members of the Senate and the House of Representatives who feared for their lives for hours, damaged the Capitol building as they broke in and paraded around with Trump and confederate flags, in an attempt to murder the Speaker of the House and the Vice President.
Sedition criteria have been met in my view and the responsible parties- President Trump, his violent mob, and Rudy Giuliani (at least)- all need to be held accountable.
Here is how that stands so far:
- President Trump has been impeached a second time by the House of Representatives for “Inciting an Insurrection”. Soon the Senate will vote on the article.
- The FBI is rounding up members of the Capitol Hill Insurrection and charging them in the minimum with misdemeanor trespassing and in the maximum with felony seditious conspiracy which holds a 20 year sentence if found guilty.
- The New York State Bar Association is looking to remove Giuliani’s membership.
Dictionary Definition of Sedition: “the stirring up of discontent, resistance, or rebellion against the government in power”
Legal Definition of Seditious Conspiracy: “The federal law against seditious conspiracy can be found in Title 18 of the U.S. Code (which includes treason, rebellion, and similar offenses), specifically 18 U.S.C. § 2384. According to the statutory definition of sedition, it is a crime for two or more people within the jurisdiction of the United States:
To conspire to overthrow or destroy by force the government of the United States or to level war against them;
To oppose by force the authority of the United States government; to prevent, hinder, or delay by force the execution of any law of the United States; or
To take, seize, or possess by force any property of the United States contrary to the authority thereof”
